Terms and Conditions SM Factory
By accessing and using the SM Factory website and services, you expressly agree to the following terms and conditions of sale.
The prices and any promotions mentioned are only valid at the time of publication on the site. All prices include VAT, but excluding any shipping costs.
When ordering goods via email or buying goods at a sales booth, the sales contract is drawn up. You therefore legally accept the full, present general terms and conditions. The sales contract only becomes definitive when it is confirmed by the buyer paying the price. Pain Factory reserves the right to refuse an order if certain irregularities occur. You will be notified of this by e-mail within 24 hours.
If you place your order as a company, you can receive an invoice after providing your complete details.
The goods in stock at the time of purchase will be delivered to your home within 7 working days of receiving your payment. In case of stock depletion you will be informed by e-mail of the possible longer delivery time. The latter cannot give rise to cancellation or refusal of the order and cannot lead to compensation. If an incorrect delivery address is specified by the buyer, or the goods cannot be delivered to the specified address, the costs for new shipment will always be borne by the buyer. In certain cases of force majeure, the seller can be released from his obligation to deliver (eg war, fire, strike, etc.). In this case the buyer will be reimbursed immediately.
Loss or damage during transport
In accordance with the law on trade practices, loss and / or damage to an ordered product is borne by the seller. Any damage must be notified to us immediately upon receipt. Otherwise there can be no question of a return or replacement of the goods.
The Belgian law on trade practices of July 14, 1991 allows the consumer to inform the seller within 7 working days from the delivery of the product that he or she is abandoning the sale. The goods must then be returned, undamaged, unused and unopened, within 5 working days after he informed the seller by e-mail. This cooling-off period does not apply to direct sales in our store, to a product stand, from a sales cabinet, via one of the employees of SM Factory or to customized goods. This reflection time also does not apply to a sale to a company.
From a hygienic point of view, we cannot return any items that are intended for intimate use.
SM Factory will refuse returned goods or not refund them if the original packaging was opened or if the products were damaged or used by the buyer. SM Factory does not bear any costs or responsibility with regard to the return of goods by the buyer. Unstamped or insufficiently stamped shipments are always refused and sent back to the sender. Goods that are returned without prior notice will not be accepted. Correctly returned goods are refunded within 15 days.

Complaints can be submitted by email via firstname.lastname@example.org. SM Factory undertakes to handle and answer every complaint within 7 working days.
The items that we sell are described and depicted on our website as precisely as possible. If, despite all our precautions, an error occurs on our website, we cannot be held liable for this fact.
